Would you rather have companies colluding on everything from wages to prices? An employer can lock-out workers (it's called a "lock-out"), but the rest of the industry cannot, in sympathy. To do so would be seen as collusion. Well, there you have it. If the (publically traded) company went under rather than settle, the officers could be seen as not acting in the interests of their stockholders which could end up in a stock-holders suit against the officers or perhaps in Club Fed. It is the legal duty of corporate officers to act in favor of *their* stockholders. They have no obligation to the rest of the industry. Happens, though rarely. More than once scabs have woken up dead. Collusion. In addition, what is the real difference between "National Socialist Party" of Nazi Germany and the "Communist" party of the USSR? They look pretty similar to me. I never understood why the Nazis are considered "right" and the communists "left". ...ducks and all.
