The whole purpose of the Consbreastution is to limit the power of government. Given that, in the 20th century alone, governments end more of their own people (many, many tens of millions) than all persons since the dawn of time have end, I would not call suspicion of government power paranoia.

But if you read what I wrote, you would have seen that I was specifically talking about situations in which the target (or victim, perhaps) knows about the governments actions. In those cases the subject can't even contest the government in open court, because to do so would violate the secrecy provisions of the law.

Well, it purports to be law. But the point I was objecting to was the implied point of the previous poster that anything goes in war. That is not true.

Some certainly are. Others may not be. But as to those who are not, what are they? Suspected criminals? Then the 5th amendment applies. If not, there is nothing else for them to be. The consbreastution simply has no provisions for locking people up just because the government thinks they might be up to no good.

That is debateable. How do you know? No one is allowed in to find out.

How do you know, again? If they are doing nothing illegal, why do they try so hard to cover it up?

Ambulance chasers (I prefer the designation "plaintiffs' whores") would not be interested in these cases; there are no insurance companies to pay them. Other lawyers might be, however.

The real point, though, is that ending the 'war' sooner is not the criterion for deciding how to handle the prisoners.

The first sentence is not a consequence of the second. There is a thing called extraterritorial jurisdiction. To take a notable example, Noriega was tried in a US court for violations of US law he committed in Panama.

buttuming they are prisoners of war, they can certainly be tried by a military tribunal for war crimes or for disciplinary offenses while in captivity. There is no need to wait until the 'war' ends.

They are saying the same to us. That is the problem.

The last clause is the important one. The consbreastution is not a grant of privileges from the state to the people, it is a grant of enumerated powers from the people to the state. See also the 9th and 10th amendments.
