In those cases the subject can't even contest the government in open court, because to do so would violate the secrecy provisions of the law. Well, it purports to be law. Then the 5th amendment applies. If not, there is nothing else for them to be. No one is allowed in to find out. How do you know, again? If they are doing nothing illegal, why do they try so hard to cover it up? There is a thing called extraterritorial jurisdiction. To take a notable example, Noriega was tried in a US court for violations of US law he committed in Panama. The last clause is the important one. The consbreastution is not a grant of privileges from the state to the people, it is a grant of enumerated powers from the people to the state.
