No charges does not equate to doubt. There can be many reasons not to lay charges. Even if you considered the Geneva Conventions apply, there are issues: AFAIK, ConIII Art4(A)(1) does not apply...

Read the convention, specifically Article 4(A)(1). It does not say that. If you claim it does, provide a citation (that is, a statute, treaty, case, or other authority that supports your claim).

Provide a citation. Article 12 seems to say otherwise: "Prisoners of war are in the hands of the enemy Power, but not of the individuals or military units who have captured them."

Provide a citation. Article 17: "No physical or mental torture, nor any other form of coercion, may be inflicted on prisoners of war to secure from them information of any kind whatever. Prisoners of war who refuse to answer may not be threatened, insulted, or exposed to unpleasant or disadvantageous treatment of any kind."

According to this administration, it does not even apply to US citizens arrested in the US. See Hamdi.

Provide a citation.

Now, I am not a lawyer, nor an expert on the law of war, but the meaning of the Convention seems crystal clear. If I am wrong, prove it, don't just contradict.
