Depends on how the programmer wrote his program in this case. If you write it as pid = fork() and don't check pid you are in trouble. If the return is a negative, I believe, then it means a failure. But the fact that init is the ultimate parent, and if the child fails for whatever reason, then init is in control. A nice feature if you ask me.
