Sorry, but that is precisely the same kind of shallow non-analysis as you've just performed. It doesn't actually state the language of Apple and Apple Corp's Debt Settlement agreement.

Then there's the simple fact that you've cherry-picked the statement from that article that you think wins you a point. Leaving out little details like:

"But some important language in the case appears to support Apple Computer's claim that it did not break previous trademark agreements or contracts. "

and:

"Although that pact remains private, key portions of it are cited in public court papers. And one of those pbuttages in the court document strongly implies that Apple Corps agreed to allow Apple to pursue digital music initiatives, but not package, sell, or distribute any physical music materials such as CDs."

And, of course, you're completely ignoring the fact that Apple Computers went on to win the suit that to which the article is referring.
