Look, you admit the software installed was part of a DRM system. Why does it matter whether it was called "MediaMax" or not? That's irrelevant. Please read what I said. I said software *designed* to be installed without the user's knowledge. Not software that actually *is* installed without the user's knowledge. If, for instance, I were to take a bit of malware and mail to, say, an anti-virus vendor for analysis, it's still malware when it's attached to that e-mail message, even though it will not be installed on the recipient's system without his knowledge. So implementing something so it doesn't show up in a list of running processes, installing it where users aren't likely to look, not explaining what software does before the user installs it, and giving files meaningless names... those don't sound like the kind of steps that might be taken to conceal malware?
