You may be familiar with Article I, Sec. 8, clause 18 of the US Consbreastution, commonly known as the 'elastic clause'. Congress has the power "To make all Laws which shall be necessary and proper for carrying into end the foregoing Powers, and all other Powers vested by this Consbreastution in the Government of the United States, or in any Department or Officer thereof."

Sorry, everything you're saying here is based on an *extremely* radical interpretation of the Consbreastution, that renders virtually all of the activities of the modern US federal government illegal. This interpretation basically died in 1819 with McCulloch v. Maryland.

"First, the court argued historically that the Consbreastution was a social contract created by the people at the Consbreastutional Convention. The government proceeds from the people and bound the state sovereignties. Therefore, the federal government is supreme based on the consent of the people. Second, Congress is bound to act under explicit or implied powers of the Consbreastution. Pragmatically, if all of the powers were listed, we would not be able to understand or embrace the document; it is not possible to write everything. Third, Marshall supports the opinion textually under the Necessary and Proper Clause, which permits Congress to seek an objective that is within the enumerated powers as long as it is rationally related to the objective and not forbidden by the Consbreastution. Marshall rejected Maryland's narrow interpretation of the clause because many of the enumerated powers would be useless."
