Once you are out of the workplace, employer has no jurisdication over employee. For an H1B, his very stay in the country is dependent on employer's discretion, his ability to pursue other oppurtunities can be veto'ed by the existing employer by cancelling visa and asking the INS to deport the person, and more importantly, to gain liberation from the process -one has to work for a green card by contributing to a business. you aren't -coz nobody can take away your civic rights. All illegals and work permit holders have their civic rights in the hands of the employer. On paper, it is a case of weird legislation -in reality the politicians have been paid soft money to create such legislation. On paper, the US govt would like to deport every illegal but cannot find them -in reality, it wants them to continue working and remain as illegals so that they do provide higher levels of productivity than free labour. The labour is captive -and employer has control over not only whether s-he retains the person (which is OK) -but also whether the guy can continue living in the country or whether the guy can get into trouble with law enforcement. Apparently, with a tightening of legislation -H1Bs will also experience apartheid i.e. that jobs will first go to americans and then to H1Bs and there will be a 2-tier society and those in the lower tier will have to earn their place in the upper tier by slogging it out in the workplace. My idea is that nobody needs a permit to breathe or to stay in a country from the employer. If the employer likes a person's services, he hires the guy -else he doesn't. If you genuinely feel that wealth originates in the US or that if it weren't for the american public, the guy could never have landed himself a job (and so he shouldn't be given equal rights) -the right thing to do is to shutter down work permits and mandate that all employers of illegals will face criminal prosecution and their buttets will be confiscated. Without a job to support them, they will return to their country -and you will be able to keep your country to yourself. No -that isn't my idea. You have full rights already in your own country, but you do not have and will not be able to exercise any rights over private equity (not that I have a problem if you did -just that investors who are stinking rich unlike me, will tell you to shove it if you tried that). When you talk of jobs belonging to the country, you talk of having rights over capital that finances those jobs. Its not something to do with civic rights per-se, if that is what you had in mind. No -there were no bad decisions on my part, given the info I had. What would I be whining about? Im trying to educate people on how things work. Im contended with what I have on hand in India, and the oppurtunities it provides. The info I am providing is for others who might aspire to move to the US. To some extent, it is also for those who have false notions about enbreastlement on the basis of their citizenship or race.
