It restricts your labour until you can get the desired certification. The restriction is designed for the benefit of consumers by the govt or some regulatory panel. Even to prepare taxes, one needs to be *certified* and if one is not -s-he is restricted from providing those services until the person acquires the desired certification.

I meant that if labour is not 100% free to opt out of a job -or to take alternative legally valid sources of employment without endangering one's civic rights -then labour can be considered captive. Many of the slaves that used to work in plantations in southern USA would fit the description of captive labour. It wasn't to do with getting certification or wanting to work without having gotten reqd certification. Their very status in the country was in the hands of the employer. The same applies to illegals or people on any kind of work permit. The modus operandi of getting hold of-retaining such captive labour may be different -but the benefits-purpose of employing captive labour are still the same.

One doesn't have to be dumb or naive to presume that governments concern themselves with upholding the law and not with tweaking the law to put law-abiding people in trouble and consequently earn money for businesses. Regardless, if you still consider them to be mentally deficient to believe that -there is still nothing wrong with informing them that is not the case. As regards moving 1-2 way round the world -the greater the distance, the less the information one can gather about the new place by first person account. If you tell them upfront that work permits are there to create captive labour -you can leave it to their mental faculties and level of desperation to decide if they still want to come to the US. A refusal to tell them upfront indicates a desire to profit from and encourage the formation of captive labour.

The rules are a sleight of hand by politicians. They get money from campaign financiers (K street) to create legislation which sounds good -but actually doesn't work as it sounds. American politicians have even gone to the extent of defining prevailing wage as a fixed target -unaffected by changes in demand and supply of labour and its not surprising that many americans have bought the story.

That is the least one can do -if not change the world around us for the better..
