Terms used in legal senses very frequently don't correspond with common usage. For example, you can easily claim your toothpaste is "the best" (meaning, in a legal sense, 'as good as any other'), but you'd better be able to point to some evidence if you claim yours is "better".
No, I very specifically didn't comment on their validity *as a licence term*. The *reason* they are in the license in the first place is that copyright *doesn't* forbid such copying.
Tell ya what. Cite a case with the facts as I have outlined (copying to other forms, for personal use, no distribution to others) and I'll gladly concede you're right. Until then... nope.
If you're right, that shouldn't be hard, right? C'mon, just one little prosecution? Or even a lawsuit?
(Of course, even by the terms of the NET Act, such infringement must be "willful", as, in the words of Orrin Hatch, "the intent to violate a known legal duty".
