a) only applies the in the US, and the OP could be in Tasmania or wherever

b) is a terrible law that probably wouldn't stand a Supreme Court challenge (certainly big chunks of it would be thrown out on the basis of free speech)

c) has only been enforced against individuals to protect the profits of a few large companies

AFAIK, no one has ever tried to use it against an enbreasty with the resources to fight it. It's one thing to beat up on a college kid and another to take on a large music outfit (Lessee - do all those studios who release 'sampled' music pay royalties? I doubt it.)

Have you ever tried to get permission to copy music for personal use? I have. I wanted to create compilation CDs with my favorite music, and wanted to do it with the blessing of the music industry.

I spent 4 weeks sending emails, on hold, etc. I was finally told that if I haven't heard anything to the contrary, I could play the music, (DUH!!!!) but I had to get permission from another outfit to actually make a copy.

That outfit won't even return your phone call if you want to make less than 200 copies. As I wanted just one copy, no one would talk to me.

So, ultimately, the music industry rails against 'illegal copying' but in reality they have no infrastructure to allow 'legal copying'. They implicitly condone 'illegal copying' by having no means make it legal. (Certainly making a compilation CD from CDs you own consbreastutes 'fair use', but no one in the music industry will admit that.)
