They may* want *to sue someone when their software goes bad, but they're most likely prevented from doing so. Read the EULA. Notice the part in section 16 in this document:
16. DISCLAIMER OF WARRANTIES. Except for the Limited Warranty and to the maximum extent permitted by applicable law, Microsoft and its suppliers provide the Software and support services (if any) AS IS AND WITH ALL FAULTS, and hereby disclaim all other warranties and conditions, whether express, implied or statutory, including, but not limited to, any (if any) implied warranties, duties or conditions of merchantability, of fitness for a particular purpose, of reliability or availability, of accuracy or completeness of responses, of results, of workmanlike effort, of lack of viruses, and of lack of negligence, all with regard to the Software, and the provision of or failure to provide support or other services, information, software, and related content through the Software or otherwise arising out of the use of the Software. There is also a bunch of crap in that license (above), but to be clear, no license for software that I know of says that the software will work at all.
I believe this lask of warranty is still an argument for open source software. If there is no guarantee that it will work, and the risk is placed back on the user, then he can choose to verify whether the software meets his needs by checking the source directly. With closed source software, you don't know and there is not a thing you can do about to minimize your risk.
This is a design problem Microsoft needs to address. Win xp Home just gives you the two choices: Limited and Computer Administrator, and the first is too limited and the second is too powerful...
