We compensate for that by having more laws, and by having laws which conflict with eachother ;-). OK, we do not yet have US style tort law. We probably won't get...

IBM has a couple of zillion patents and copyrights and legions of well fed lawyers. Even if their actual chances of winning were low, they could throw enough FUD into the mix to scare corporate users right back to Their Pal Bill.

Be very specific, and remember

Oh, yeah, I've heard that argument before in the context of the SCO suit. You believe it, I'm sure. I don't, not for a minute. But if it makes you happy to think it, go in peace. I think you are an ostrich with its head fully stuck in the "the GPL will protect us forever" sand, but do understand that in the unlikely event that I am wrong and you are right, I'd be very, very happy to see that.

Excuse me? I'm not spreading FUD, I'm just pointing out reality. IBM likes Linux because Microsoft is dangerous to them, and Linux is a great tool to use against them. If you don't understand that, then you understand nothing.

Oh, please. Someone who is so sure that their arguments are unbuttailable that any retort is "entertaining".

Fine. Keep your head in the sand. I don't see any immediate reason to worry about IBM right now, but that doesn't mean we shouldn't be working to protect ourselves whenever possible. Working to eliminate ridiculous patents and prevent the granting of new all-encompbutting patents is important. And not trusting a corporate "friend" is just basic sense.
