Yes, this is how I understand it, too, from lurking on the Groklaw website and the Yahoo SCOX message board. It's clear now (1) SCOX claims to having any control over ANY "traditional" *nix codebase (from ATT forward) are at best EXTREMELY dubious; and (2) even if such control existed, there's none of that "controlled" code in Linux, anyway.

In fact, SCOX has been asked directly by the court to provide this control evidence (copyright as well as the trail to Linux) TWICE now, and has been absolute silent about it. It's a tribute to the patience of the court that the SCOX charade continued as long as it has.

SCOX appears completely hopeless. They're deliberately doing everything to avoid the courtroom, any ruling on facts, and their butt whupped by the IBM Nazgul lawyers in public.

The countersuits (by IBM, etc.) will be considered after the court makes a ruling on the likelihood of SCOX having evidence worthy of a jury trial (I think possibly in the late summer or early fall timeframe).
